1. Who We Are

Draw & Animate (“we”, “our”, “the app”) is a mobile application that lets children photograph their hand-drawn artwork and transform it into stylized illustrations and animated videos using artificial intelligence. The app also offers optional physical products including printed art books (via Lulu Direct) and custom merchandise such as t-shirts, hoodies, tote bags, and mugs (via Printful).

2. Children’s Privacy (COPPA Compliance)

Draw & Animate is intended for use by children ages 4–12 under parental or guardian supervision. We comply with the Children’s Online Privacy Protection Act (COPPA).

• We do not require children to create accounts or provide personal information to use the core app features.
• We do not collect names, email addresses, or phone numbers for general use.
• We do not use tracking, behavioral analytics, or advertising SDKs.
• We do not share any data with third parties for marketing or advertising purposes.
• Kid profile names (first name or nickname only) are stored on the device only and are never transmitted to our servers during normal use.
• When a physical product is ordered, a parent or guardian must provide a shipping address and email. Children should not enter this information themselves.

3. What Data We Collect

Stored on your device only (never sent to us):

• Kid profile information (first name or nickname, chosen avatar color and icon)
• Saved creations (original photos of drawings, AI-stylized images, titles, art style used)
• Credit balance
• App preferences and settings
• Order history references for physical products

Temporarily processed on our servers:

• Photos of drawings: When you use the AI stylization feature, the photo is sent to our server and forwarded to AI services (Google Gemini or OpenAI) for processing. The image is used solely to generate the styled version and is not stored permanently on our servers.
• Audio recordings: If you use the voice recording feature, audio is sent to our server for transcription only and is not retained after processing.
• Stylized images for physical products: When a storybook or merchandise order is placed, the relevant artwork images are sent to print fulfillment partners (Lulu Direct or Printful) for production. See Section 4 below.

4. Physical Products & Shipping Data

Draw & Animate offers two optional physical product features. These features require collection of additional information from a parent or guardian:

Storybook (via Lulu Direct):

• A shipping name and address is collected to fulfill the printed art book order.
• Payment is processed by Stripe. We do not store payment card details.
• Selected artwork images are transmitted to Lulu Direct for PDF generation and printing.
• Order records (order reference, status, amount, shipping address) are stored on our servers for order tracking purposes.

Custom Merchandise (via Printful):

• A shipping name, email address, and address is collected to fulfill the merchandise order.
• Payment is processed by Stripe. We do not store payment card details.
• The selected artwork image is transmitted to Printful for product printing and order fulfillment.
• Order records (order reference, status, amount, product details, shipping address) are stored on our servers for order tracking purposes.

5. Third-Party Services

We use the following third-party services to power app functionality:

• Google Gemini / OpenAI: AI image stylization and audio transcription. Images are processed per their respective privacy policies. We do not opt in to any training data programs.
• Runway ML: AI video generation from stylized images. Images are sent for video production only, subject to Runway’s privacy policy.
• RevenueCat: In-app purchase management. Transactions are processed through Apple’s App Store. No personal information is shared beyond what Apple provides for purchase processing.
• Stripe: Payment processing for physical product orders (storybooks and merchandise). Stripe handles all card data directly and is PCI-DSS compliant. We never see or store full payment card details.
• Lulu Direct: Print-on-demand partner for art book orders. Your name, shipping address, and selected artwork are shared with Lulu solely to produce and ship your order, subject to Lulu’s privacy policy.
• Printful: Print-on-demand partner for merchandise orders (t-shirts, hoodies, mugs, tote bags). Your name, email, shipping address, and selected artwork are shared with Printful solely to produce and ship your order, subject to Printful’s privacy policy.

6. In-App Purchases

Draw & Animate offers optional credit packs as in-app purchases processed through Apple’s App Store via RevenueCat. We do not directly collect or store any payment information for in-app purchases. Credits are used to generate AI artwork (1 credit per stylization) and animated videos (4 credits per video).

7. Copyright & Intellectual Property — User Content

Your Responsibility for the Content You Submit

When you submit a drawing or image to Draw & Animate for AI stylization, storybook printing, or merchandise production, you (the parent or guardian placing the order) represent and warrant that:

• The original drawing was created by the child and is not a direct copy or tracing of a copyrighted character, logo, or artwork owned by a third party.
• You have the legal right to reproduce, transform, and commercially print the submitted image.
• The image does not infringe any copyright, trademark, trade dress, or other intellectual property rights of any person or company.
• The image does not contain any recognizable brand logos, licensed characters (e.g., Disney, Marvel, Pokémon, Hello Kitty), or other protected marks.

Common Examples of Problematic Content

The following types of content should not be submitted for physical print orders:

• Drawings of licensed cartoon characters (Mickey Mouse, Peppa Pig, Pikachu, Spider-Man, etc.)
• Copies or tracings of characters from books, movies, TV shows, or video games
• Drawings that include brand logos or recognizable trademarks
• Reproductions of published artwork or photographs

Drawings of original characters invented by the child are perfectly fine and are exactly what this app is designed for.

Why This Matters for Printed Products

Printing copyrighted characters on merchandise or in books—even for personal use—may infringe the intellectual property rights of the copyright or trademark holder. Print fulfillment partners (Lulu and Printful) also have their own content policies and reserve the right to refuse orders that violate intellectual property rights.

Our Liability Disclaimer

Draw & Animate is a technology platform. We do not review or screen individual artwork submissions for intellectual property compliance before processing orders. By placing an order, you accept full responsibility for ensuring your submitted content does not infringe any third-party intellectual property rights.

Draw & Animate shall not be liable for any claims, damages, or losses arising from a user’s submission of infringing content. If a print order is refused or canceled by a fulfillment partner due to a content policy violation, refunds will be at the discretion of the fulfillment partner.

AI Transformation Notice

The AI stylization feature transforms a drawing into a new artistic style. While AI transformation may alter the appearance of submitted content, transformation alone does not eliminate copyright or trademark infringement risk. If the original drawing depicts a protected character or image, the transformed version may still infringe those rights.

8. Data Storage & Security

• All user-created content (drawings, profiles, credits) is stored locally on your device using secure on-device storage.
• Images uploaded for AI processing are stored temporarily on our servers and are automatically deleted after processing.
• Physical product order data (shipping address, order reference) is stored on our servers for order tracking only.
• We use HTTPS encryption for all data transmitted between the app and our servers.
• We do not maintain user accounts or databases containing personal information beyond what is necessary for active orders.

9. Device Permissions

• Camera: Used solely to photograph hand-drawn artwork for AI stylization. Photos are not accessed for any other purpose.
• Photo Library: Used solely to let you select an existing photo of a drawing. Not accessed for any other purpose.
• Microphone: Used only when the voice recording feature is active, allowing children to narrate stories about their artwork. Audio is processed for transcription and not retained afterward.

10. Data Retention

• On-device data (profiles, creations, credits) persists until the user deletes it or uninstalls the app.
• Uploaded images for AI processing are automatically removed from our servers after the stylized result is returned.
• Physical product order records are retained on our servers for up to 2 years for order support purposes, then deleted.
• We do not maintain any long-term databases of user-generated content or personal information beyond what is described above.

11. Parental Rights & Controls

Since the majority of data is stored on the device, parents have significant control:

• View, edit, and delete all saved creations and profiles within the app.
• Delete any creation or profile at any time directly in the app.
• Uninstall the app to remove all locally stored data.
• Contact us to request deletion of any order data we hold for physical products.
• No general account deletion request is needed since we don’t maintain user accounts for core app functionality.

12. Limitation of Liability

Draw & Animate is provided “as is” without warranties of any kind. To the maximum extent permitted by applicable law:

• We are not responsible for the quality, accuracy, or content of AI-generated images or videos.
• We are not liable for delays, errors, or quality issues with physical products produced and shipped by third-party fulfillment partners (Lulu, Printful).
• We are not responsible for any intellectual property infringement resulting from content submitted by users.
• Our total liability for any claim related to the app or physical products shall not exceed the amount you paid for the specific product or service giving rise to the claim.

13. Copyright Infringement / DMCA

If you believe that content processed through Draw & Animate infringes your copyright, please send a written notice to our contact email below that includes:

• Identification of the copyrighted work claimed to be infringed.
• Description of the infringing material and where it appears.
• Your contact information (name, address, email, phone).
• A statement that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law.
• A statement made under penalty of perjury that the information in your notice is accurate and that you are authorized to act on behalf of the copyright owner.
• Your physical or electronic signature.

We will respond to valid DMCA notices in accordance with applicable law.

14. Changes to This Policy

We may update this privacy policy and terms from time to time. Any changes will be reflected on this page with an updated “Last updated” date. We encourage parents to review this policy periodically. Continued use of the app or placement of a product order after changes are posted constitutes acceptance of the updated terms.
