Our commitment: Draw & Animate is designed for children ages 4–12. We collect the absolute minimum data needed to operate the app and never sell, share, or use personal information for advertising.
1. Who We Are
Draw & Animate is a mobile application that lets children photograph their hand-drawn artwork and transform it into stylized illustrations and animated videos using artificial intelligence. The app also offers optional physical products including printed art books (via Lulu Direct) and custom merchandise such as t-shirts, hoodies, tote bags, and mugs (via Printful).
2. Children's Privacy (COPPA Compliance)
Draw & Animate is intended for use by children ages 4–12 under parental or guardian supervision. We comply with the Children's Online Privacy Protection Act (COPPA).
- We do not require children to create accounts or provide personal information to use the core app features.
- We do not collect names, email addresses, or phone numbers for general use.
- We do not use tracking, behavioral analytics, or advertising SDKs.
- We do not share any data with third parties for marketing or advertising purposes.
- Kid profile names are stored on the device only and are never transmitted to our servers during normal use.
- When a physical product is ordered, a parent or guardian must provide a shipping address and email. Children should not enter this information themselves.
3. What Data We Collect
Stored on your device only (never sent to us):
- Kid profile information (first name or nickname, chosen avatar)
- Saved creations (original photos, AI-stylized images, titles, art style)
- Credit balance
- App preferences and settings
- Order history references for physical products
Temporarily processed on our servers:
- Photos of drawings: Sent to AI services (Google Gemini or OpenAI) for processing. Not stored permanently.
- Audio recordings: Sent for transcription only and not retained after processing.
- Stylized images for physical products: Sent to print fulfillment partners for production.
4. Physical Products & Shipping Data
Storybook (via Lulu Direct):
- A shipping name and address is collected to fulfill the printed art book order.
- Payment is processed by Stripe. We do not store payment card details.
- Order records are stored on our servers for order tracking purposes.
Custom Merchandise (via Printful):
- A shipping name, email address, and address is collected to fulfill the merchandise order.
- Payment is processed by Stripe. We do not store payment card details.
Important: Shipping addresses and order data are used solely for order fulfillment and are never used for marketing.
5. Third-Party Services
- Google Gemini / OpenAI: AI image stylization and audio transcription.
- Runway ML: AI video generation from stylized images.
- RevenueCat: In-app purchase management via Apple's App Store.
- Stripe: Payment processing for physical product orders. PCI-DSS compliant.
- Lulu Direct: Print-on-demand partner for art book orders.
- Printful: Print-on-demand partner for merchandise orders.
6. In-App Purchases
Draw & Animate offers optional credit packs as in-app purchases processed through Apple's App Store via RevenueCat. We do not directly collect or store any payment information. Credits cost 1 per stylization and 4 per video.
7. Copyright & Intellectual Property — User Content
Please read this section carefully before ordering any physical products.
Your Responsibility for the Content You Submit
When you submit a drawing, you (the parent or guardian) represent and warrant that:
- The original drawing was created by the child and is not a copy of copyrighted content.
- You have the legal right to reproduce and print the submitted image.
- The image does not contain licensed characters (e.g., Disney, Marvel, Pokémon).
Draw & Animate shall not be liable for any claims arising from a user's submission of infringing content.
8. Data Storage & Security
- All user-created content is stored locally on your device.
- Images uploaded for AI processing are deleted after processing.
- Physical product order data is stored on our servers for order tracking only.
- We use HTTPS encryption for all data transmission.
9. Device Permissions
- Camera: Used solely to photograph hand-drawn artwork.
- Photo Library: Used solely to select an existing photo of a drawing.
- Microphone: Used only when the voice recording feature is active.
10. Data Retention
- On-device data persists until the user deletes it or uninstalls the app.
- Uploaded images for AI processing are removed after results are returned.
- Physical product order records are retained for up to 2 years for order support.
11. Parental Rights & Controls
- View, edit, and delete all saved creations and profiles within the app.
- Uninstall the app to remove all locally stored data.
- Contact us to request deletion of any order data we hold.
12. Limitation of Liability
Draw & Animate is provided "as is" without warranties. To the maximum extent permitted by law, we are not responsible for AI-generated content quality, physical product fulfillment delays, or intellectual property issues arising from user-submitted content. Our total liability shall not exceed the amount paid for the specific product giving rise to the claim.
13. Copyright Infringement / DMCA
If you believe content processed through Draw & Animate infringes your copyright, send a written notice to support@drawandanimate.com including: identification of the work, description of the infringing material, your contact information, and a statement of good faith belief and authority to act.
14. Changes to This Policy
We may update this policy from time to time. Changes will be reflected on this page with an updated date. Continued use of the app constitutes acceptance.
