Welcome to Draw & Animate! By downloading or using this app, you agree to these Terms of Use. Please read them carefully. If you are under 13, a parent or guardian must agree on your behalf.
1. About the App
Draw & Animate is a creative app that uses artificial intelligence to transform children's hand-drawn artwork into stylized digital images and short animated videos. The app is intended for children ages 4–12 under parental supervision.
2. In-App Purchases & Credits
- The app uses a credit system. Credits are consumed when generating stylized images (1 credit) or animated videos (4 credits).
- Credit packs are available for purchase through Apple's App Store or Google Play. All purchases are processed by Apple or Google — we do not store your payment information.
- All purchases are final. We do not offer refunds for credits that have been used. Unused credits may be eligible for a refund through Apple or Google's standard refund policies.
- Credits are stored per kid profile on your device and are not transferable between devices or accounts unless explicitly restored via the "Restore Purchases" feature.
- Prices are displayed in your local currency as determined by Apple or Google.

4. Children's Privacy (COPPA)
Draw & Animate is designed for children under 13. We are committed to COPPA compliance:
- We do not knowingly collect personal information from children under 13 without verifiable parental consent.
- Kid profiles are stored only on your device. Profile names and emoji are not transmitted to our servers.
- Drawings are transmitted to our AI processing servers solely to generate stylized images, and are not stored after processing.
- Parents can delete all app data by uninstalling the app or clearing app data in device settings.

5. Intellectual Property & Your Artwork
- You (the parent/guardian on behalf of the child) retain ownership of the original hand-drawn artwork.
- By using the app, you grant us a limited, non-exclusive license to process your artwork images through our AI systems solely to provide the service (stylization and animation).
- AI-generated images are provided for personal, non-commercial use. We make no guarantee that AI-generated images are free of third-party intellectual property claims.
- You may not use AI-generated content for commercial purposes without independent legal review.
6. Prohibited Uses
You agree not to:
- Upload content that is illegal, harmful, abusive, or inappropriate for children.
- Attempt to reverse-engineer, hack, or misuse the app or its AI systems.
- Use the app in violation of any applicable law or regulation.
- Share generated content that infringes third-party intellectual property rights.
7. Physical Products (Storybooks & Merchandise)
- Storybook printing is fulfilled by Lulu Direct. Merchandise is fulfilled by Printful. We act as a reseller; fulfillment is managed by these third parties.
- All physical product sales are final. Refunds or replacements for defective products may be requested within 14 days of delivery by contacting us.
- Shipping times and costs are estimates. We are not responsible for delays caused by carriers or customs.
8. Disclaimers & Limitation of Liability
The app is provided "as is." We do not guarantee that the AI will produce any particular result. To the fullest extent permitted by law, we are not liable for any indirect, incidental, or consequential damages arising from your use of the app.
9. Changes to These Terms
We may update these terms from time to time. Continued use of the app after changes constitutes acceptance of the updated terms.
